Terms and Conditions

I – General Provisions

1. Object

This document governs the pre-contractual, contractual and post-contractual terms applicable to the use of the Site, as well as all distance selling agreements that may be entered into with you through TuartStore.
TuartStore offers online sale of fashion apparel and accessories to end consumers.
In addition to the other legislation, the acts referred to in the previous article also apply the Privacy Policy defined in an independent document.
These conditions apply exclusively to non-trader natural persons.

2. Definitions

For the purposes defined in these conditions:
1. Website: The present website, located at www.tuartstore.com;
2. Domain: The address www.tuartstore.com;
3. User: Quality that is automatically assigned to anyone who accesses the Site;
4. Owner: The proprietor of ownership of the Site.
5. Store: Site space dedicated to announcing products as well as completing the buying and selling process located at www.tuartstore.com/loja/.
6. TuartStore: Abbreviated designation of the Store and Owner as the grantor of the purchase and sale agreements.

3. Conditions of Access

Access to and use of the Site implies that the User fully and unreservedly accepts all the provisions set forth herein, in the version in effect at any time accessing the Site.
If you do not fully accept any of the conditions set forth and in effect at the date of access, you must not access or use the Site.
By consulting or using any of the features of the Site, the User undertakes to respect the conditions set forth herein.
Access to the Site is free, however, additional requirements may be set for certain features.
You may only make purchases on the Site if you are at least eighteen (18) years of age and / or are of legal age or emancipated in the jurisdiction of your place of residence and have the legal possibility to contract and use your own means of payment, the expressly declaring at the time of order confirmation.
You may not make fraudulent use of the Site contrary to law or morality.

4. Property

II – Registration and use

5. Registration

To access all features of the Site, the User must register by filling in the form provided for this purpose.

6. Use

After registration, you will have access to your Reserved Area at https://www.tuartstore.com/my-account/.
Access to the Reserved Area depends on prior authentication, through a form provided for this purpose, in which the access credentials defined in the terms of the previous article must be entered.
In the Reserved Area, the User must fill in his personal data, by indicating his name, address of his domicile in a complete and correct way, which will be used, in particular, for the purpose of sending purchases that may be made on the Site. , as well as the other data requested.
The User undertakes to respect the security rules in the use of the site, namely not sharing their access password with third parties, and using updated and protected systems.
The data collected will be treated in accordance with the Privacy Policy.

III – Purchase and Sale Process

7. Generalities about the process

The information contained in this document, as well as the values and other information regarding each product advertised, does not constitute a sale proposal, but merely an invitation to negotiate.
The distance purchase and sale contract will not be concluded until the order is shipped to the User, which will be noted in the Order, contained in the reserved area of the Site.
Until the order is sent, the buying and selling process may be canceled at any time, namely for stock outage or breaking, by simply communicating via email to the User.
In the event of cancellation referred to in the previous paragraph, the User will be refunded of all amounts eventually paid, which will happen within a maximum of 2 days from the date of cancellation.

8. Product Announcement

In the Shop you can find the products for sale, and choose the ones you want to purchase.
The user can access the various menus available, in view of the location of the desired product, as well as the specific characteristics of them.
TuartStore presents real photographs of the advertised products, making sure that their graphic representation is as close as possible to reality, in order to properly clarify the User.
Notwithstanding the preceding paragraph, TuartStore cannot be held responsible for any changes in the visual characteristics of the advertised products, resulting from any incorrect definitions of the electronic devices through which the User accesses the Site.
If there is any doubt about the advertised product, namely features or other attributes, the User should contact customer support through the means advertised on the Site.

9. Product Choice

After choosing the products you want to purchase, the User must select the menu “CART”, where he will be presented a summary table of the products and quantities chosen, as well as the discriminated amounts to pay.
In the “CART” menu the User must confirm that the selected products, sizes, colors and any other variables, as well as the prices, are correct.
In the “CART” menu you can change the quantities or remove selected products as desired.

10. Shipping costs

The payment of the expenses with the dispatch of the order, which will be made under the terms defined in article 15, is the responsibility of the User.
Shipping costs are all costs related to the packaging, processing and shipping of the order, including the amounts to be paid to postal services or another company that carries the order.
The amount for shipping costs will be presented to the User in a single amount, called “Shipping”, independently of the value of the products purchased, in the “CART” menu prior to the time of purchase.
Shipping costs are € 5.00 + VAT for orders shipped to mainland Portugal, and € 15.00 + VAT for islands and Europe.
If the User makes purchases worth more than 50,00 € and they are sent to mainland Portugal, will not pay any shipping costs.

11. Coupons

The Store has the ability to enter into force promotional, discount or other coupons, which it will award under the conditions announced at the time of its launch.

12. Order Completion

The User must be authenticated in order to finalize the order; If not yet registered or authenticated, you must proceed as described in II – Registration and Use.
Before pressing the “PLACE ORDER” key, or giving the payment order, at the end of the ordering operation, you should read these Terms carefully, and give your assent to them, by selecting the check box available for this purpose.
If you do not agree to these Terms, in whole or in part, you should refrain from placing any order and immediately cancel the process.
If you do not consent to the terms and conditions as well as the Privacy Policy, you will not be able to complete the ordering process.

13. Prices

Prices shown in the store are in Euros, and include VAT due, calculated at the prevailing rate.
In addition to the price of the product, shipping costs, in accordance with article 10, may vary depending on the country to which the order is shipped.
Prior to payment, the User will be presented with the full amount to be paid, broken down.
TuartStore reserves the right to change prices at any time without notice.
The preceding paragraph does not apply to orders already made and paid.
In the event of a computer, manual, technical, or other error that causes a substantial unanticipated change in TuartStore’s selling price to the public, the purchase order will be considered invalid and void.

14. Payment

The User must make the payment of his order, prior to processing it.
The User is offered the possibility to pay for:
1. Paypal;
2. ATM Reference (through Easypay – Instituição de Pagamento Lda);
3. Credit Card (Easypay – Instituição de Pagamento Lda or Paypal).
For payments through Paypal, the order will be processed after payment is confirmed.
All PayPal transactions are subject to the PayPal Privacy Policy (also known as the Privacy Statement).
TuartStore, as well as the User, shall employ reasonable administrative, technical and physical measures to maintain the security and confidentiality of any and all PayPal data and information, including PayPal user and PayPal data and information.
For payments by ATM reference, the order will be processed after payment, within its validity period.
In the case of payment by credit card, the debit will be made to the user’s card immediately after confirmation of shipment of the goods; If some ordered products are sold out, their value will be credited to the user’s card after the order has been closed.
TuartStore may cancel orders that have been unpaid for more than 5 days if a deadline is not set for the particular payment method used.
Along with the products will be sent the receipt invoice for them, prepared according to the data provided by the User, which are your sole responsibility.
The receipt invoice once issued cannot be reissued with changes.

15. Purchase and Shipping

After confirming the availability of the product, as well as the payment being made, the purchase process is concluded by sending the purchase to the User, considering, at this moment, the purchase and sale agreement has been concluded.
If payment is received by 4:00 pm PT, working day, the order will be shipped the same day; Otherwise, shipping will occur the next business day.
The shipment will be made by registered mail through CTT, or by a carrier that may be announced, always through a service that allows the tracking and monitoring of the purchase by the User.
The order will be shipped to your home or any other address that you indicate on the order completion form.
The shipment will be processed to the member countries of the European Union.
TuartStore will notify the User by means of a message in the reserved area of the Site, in the “Orders” menu, with notification to the email, informing the shipment and the order registration number, for tracking purposes.
The provisions of this Article shall not apply to products to be ordered, in which case the time limits for the article in question shall apply.

16. Cancellation of purchase before shipment

The User may cancel the order freely before it has been shipped.
For this purpose you should contact TuartStore at tuartstore@gmail.com stating this intention.
TuartStore will reimburse the User for any sums paid, less any transfer costs, which will be duly itemized.
Once the shipment has been completed, it is not possible to cancel the purchase.

IV – Warranty, Returns and Refunds

17. Guarantee

All products sold by TuartStore are legally warranted to be defective.
The warranty does not, under any circumstances, cover damages resulting from incorrect or improper use of the products.

18. Right of free termination of contract

The User has the right to terminate the contract without incurring any costs and without giving a reason, within 14 days from the day of acquiring physical possession of the goods.
Should you wish to terminate the agreement under this article, you must contact TuartStore at tuartstore@gmail.com, stating your intention to exercise this right.
Received the contact for termination of the contract referred to in the preceding paragraph, TuartStore will contact the User within 1 day, by the same way, giving him information on which address should return the products you want to return.
After contact, and within the deadline set in number 1, the User must send to TuartStore, to the address and in accordance with the instructions given to him, the products he intends to return.
The User must return the received products as received without any deterioration caused by improper handling, with the labels, packaging and other items that have been shipped.

19. Refund

Received the products, and confirmed their compliance with the provisions of article 17 of these terms, TuartStore will refund the amount paid, as well as the shipping costs paid by the User, within 5 working days, by transfer. bank to bank account indicated by this.
Shipping costs will be refunded according to normal shipping costs, and urgent shipping costs or large orders will not be refunded.
If the products received by TuartStore do not comply with the provisions of number 5 of article 17, the User shall not be entitled to any refund, nor to the payment of shipping costs borne by the User, being returned to him.

20. Exchanges

Within 14 days from the day you acquire possession of the goods, the User may, in addition to the rights provided for in the previous articles, exchange the purchased product for another, with different attribute, such as size or color.
If you wish to exercise the right indicated in the previous paragraph, the User must contact TuartStore through the email tuartstore@gmail.com, informing him of his intention.
Upon receipt of the communication referred to in the previous paragraph, TuartStore will contact the User within 1 day, by the same route, giving him the information on which address to send the products he wants to return.
If TuartStore finds that there is no stock for the desired product, the contact referred to in the previous paragraph will inform the User, suggesting the maintenance of the contract or reimbursement of the amounts spent.
After contact, and within the deadline set in number 1, the User must send to TuartStore, to the address and in accordance with the instructions given to him, the products he wishes to exchange.
The User must return the received products as received without any deterioration caused by improper handling, with the labels, packaging and other items that have been shipped.
If the User opts for the refund provided for in paragraph 4, the provisions of article 18 shall apply; if you keep the contract, the assets will be in your possession.
The User may use the option provided in this article once for each purchase and together for all purchased items.

21. Returns

Returns must be made in accordance with the terms of article 18, not accepting returns outside of the established in this standard.

V – Final Provisions

22. Data Protection

Data protection is regulated in the Privacy Policy, in a standalone document.

23. User Exclusion

In case of violation of these terms and conditions of access in the use of any of the services provided, TuartStore may delete and block the User.

24. Data Security

User data registered on TuartStore servers is always protected by a username and password.
Although TuartStore makes every effort, it cannot guarantee the security of the information that is transmitted, including by third party interference.
In order to better guarantee your security, we advise you to regularly change your password to www.tuartstore.com.
For your safety, TuartStore does not store any credit or debit card data on its servers.
The issue of data security will be addressed in more detail in the Privacy Policy.

25. Free amendment of Terms and Conditions

TuartStore reserves the right to amend this document at any time without prior notice or notice.
Pursuant to the provisions of the preceding paragraph, it is the User’s obligation to verify their compliance with these terms and conditions prior to using the Site and placing any order or purchase.

26. Conflicts

TuartStore is available for any clarification or resolution of any problem related to the service provided, always seeking the consensual resolution of the same.

27. Forum

In cases not resolved in court, the User and the User agree to submit the dispute to the Court of the District of Coimbra, Portugal, excluding any other.
